ARMAMENT SALE RULES FOR FOREIGN ENTITIES

 

The principles for purchasing licensed movables, i.e. strategic goods, by foreign buyers are laid down in the Act of 29 November 2000 on international trading in commodities, technologies and services of strategic significance for security of the state, as well as for maintenance of international peace and security (Journal of Laws 2023 Item 1582).

Foreign buyers are obliged to supply an import certificate or an end-user statement for the purposes of transportation or transfer of strategic goods – object of the contract – in the European Union. The import certificate should be issued by the competent authorities of the foreign importer, whereas the end-user statement by the foreign end-user. The end-user statement should contain text required by the trade control authorities and should be certified by the competent authorities of the foreign importer or consignee. 

The end-user statement should contain in particular:

  • name and address of the exporter or supplier;
  • specification of the strategic goods, their description, quantity, signature and value, as well as the control number;
  • description of the end use of the strategic goods;
  • specification of the country of destination;
  • name and address of the end-user;
  • statement forbidding the end-user to transfer the weapons to any countries under arms embargo, if the object of the trade is weaponry;  
  • statement forbidding the end-user to transfer the strategic goods to any other entity unless a control authority gives consent to such a transfer;
  • certificate issued by a competent authority in the country of destination confirming that the end-user accepted the obligations resulting from Points 6 and 7, as well as a statement issued by a competent authority in the country of destination confirming that the end-user is entitled to possess strategic goods;
  • statement issued by a competent authority in the country of destination declaring that, unless the said authority gives consent, no permission will be granted to: export, sale, lend or manage the strategic goods under the statement in any other way than stated in the said end-user statement; 
  • name and address of the foreign importer or consignee;
  • a statement forbidding the importer or consignee to transfer the weapons to any countries under arms embargo, if the object of the trade is weaponry;
  • a statement forbidding the importer or consignee to transfer the strategic goods to any other entity unless a control authority gives consent to such a transfer;
  • a certificate issued by a competent authority in the importer’s or consignee’s country confirming that the importer or consignee accepted the obligations resulting from Points 11 and 12, as well as a statement issued by a competent authority in the importer’s or consignee’s country confirming that the importer or consignee are entitled to possess strategic goods;
  • list of intermediaries, if any.

Licensed movables purchased can be collected after payment from the storage place within the period stipulated separately in each contract.
